  1. Introduction
    1. Welcome to the Trading Post’s official webstore! We are an American owned and American run small business located in Marion, Indiana. We are a single store gun and pawn store owned and operated by the founder, Brian Sills.
  2. Accepting the Terms
    1. These Terms of Use govern your use of store.tradingpostllc.net and tradingpostllc.net (hereafter collectively known as the “Site”) and provide information about the Site Service, outlined below. When you create an account or use the Site, you agree to these Terms.
    2. The following Terms apply to any and all Users that create an account for the Site for any purpose, and using the Site is an assumed agreement to the following Terms.
    3. In order to use the Site, you must first agree to the Terms upon creating an account for the Site. If you do not agree to the Terms, then you may not use the Site. You also understand and agree that the Site will treat you as being in acceptance of the Terms from that point onwards.
    4. Using the Site for any purpose is an agreement to the Terms and users will be held responsible for complying with any all Terms as set forth in this document.
    5. You may not use the Site and may not accept the Terms if (a) you are not of legal age to form a binding contract with Trading Post (hereafter known as “Owner”), or (b) you are a person who is either barred or otherwise legally prohibited from receiving or using the laws of the county in which you are a resident or from which you access or use the Site.
  3. Who Can Use the Site
    1. We restrict who can use the Site to stay fully within all applicable laws and regulations for the various industries that we represent with the large diversion of products offered on the Site. So, we need you to help us stay legally compliant by agreeing to the following:
    2. You must be 18 years old to create an account and must adhere to all applicable laws for purchasing goods from the Site
    3. You must not be prohibited for any reason from accessing the Site under applicable laws or engaging in payments relates Services if you are on an applicable denied party listing.
    4. We must not have previously disabled your account for violation of law or any of our policies
  4. Unacceptable Use
    1. By agreeing to the Terms, you agree to the following Codes of Conduct to be observed while on the Site. You agree not to:
      1. Obtain or attempt to obtain unauthorized access to the Site or to Owner’s servers, systems, network or data;
      2. Violate any applicable laws or regulations;
      3. Impersonate any person or entity; or forge or manipulate headers or identifiers to disguise the origin of any content transmitted through the Site;
      4. Post content containing advertisements or other commercial solicitations without our prior written permission;
      5. Make available or attempt to upload any viruses or any other computer code, files, programs or content designed to interrupt, destroy or limit the functionality of the Site or affect other users, or
      6. Interfere with or disrupt the Site or servers, systems or networks connected to the Site in any way.
  5. Termination of Use
    1. On becoming aware of any potential violation of these Terms, Owner reserves the right (but has no obligation) to decide whether the actions committed deserve termination of User’s account without prior notice and at Owner’s sole discretion.
    2. Except for the government entities listed below, any claims arising out of or relating to these Terms or usage of the Site will be governed by the state of Indiana, other than its conflict of laws rules; any and all disputes related to these Terms shall be conducted in the federal or state courts located in or near Marion, Indiana; and you consent to personal jurisdiction in these courts.
  6. Limits on Liability
    1. We work hard to provide the User with the best products that we can source, and strive to make sure that every listing on the Site is accurate, true, and a faithful representation of the product that the User is attempting to view. Our products, however, are provided and sold ‘as is’, and we make no guarantees that they always will be safe, secure or error free, or that they will function without disruptions, delays, or imperfections, even in their intended use. To the extent permitted by law, we also DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We cannot predict when an issue might arise with the use of any of our products, and as such we are under no circumstance liable to you, or any other user, bystander, or person involved in the use of, our products and disclaim any liability for any lost profits, revenues, income, information or data, or consequential, special, indirect, exemplary, punitive or incidental damages of any sort arising out of use of our Terms, our Site, or our products even if we have been advised of the possibilities of such damages. Our aggregate liability arising out of or in relation to these Terms shall not exceed $100 or the purchase amount of the product directly involved in the damages, whichever is greater.
  7. Intellectual Property Rights
    1. We retain all rights, properties and usage of any and all branding, logos and other significant business features (such as domain names) that are present within the Site. Usage right does not extend to any User at any time expect with prior written permission.
    2. The Site gives the User personal, worldwide, royalty-free, non-assignable and non-exclusive license to use the Site provided to you in accordance with these Terms.
    3. The Site is protected by all applicable copyright, trademark, and other laws of the United States and other foreign countries. Nothing in these Terms gives the User and rights to use our logos, branding, company name, or other significant business features in any way without prior written approval. All right, title, and interest in and to the Site are and will remain the exclusive property of the Owner. All comments, suggestions, reviews, and feedback is entirely voluntary and is free to use by the Owner as we see fit and without any form of recompense for its use and without any form of liability to the User.

  9. Payment Details
    1. Upon completion of the checkout process, card details are saved in your account for future use indefinitely. Feel free to delete payment options at any time. The Site does not store any form of backup or copy of your financial data, and upon request will provide a copy of any and all personal data, including financial data, related to your account.
    2. Our card processing is through Tactical Pay with merchant services provided by Authorize.net and cleared using Clearent.
  10. Gift Cards and Returns Processing
    1. Depending on the determination of the Owner on the processing of your return, return payment may be made in the form of a gift card for use with our webstore or our physical store. Return processing is handled on a case-by-case basis at this time and the determination is at the sole discretion of the Owner, the Online Sales Director, or any other authorized representative of the Owner.
    2. Some returns may be subject to a fee, up to and including a 20% restocking fee, additional shipping to or from our place of business, and a credit card processing fee of up to 3% of the total cart value of the order including the item being returned.
    3. The Site and the Owner are under no obligation to return any portion of the funds of any transactions at any time to the fullest extent of the law.
  11. Shipping Requirements and Restrictions
    1. We currently offer domestic shipping to the United States only. We are looking to provide international shipping in the near future.
    2. Orders must provide a valid shipping address and pending the shipping company available to the area, may or may not accept certain address types (such as PO Boxes). Any disruptions in the shipping of your order will be dealt with as quickly as possible and with clear communication via email, phone, or letter.
    3. Shipping Restricted Goods
      1. Restricted goods (such as knives, firearms, ammunition, fireworks, gun powder, blackpowder, etc) do follow special rules and regulations when it comes to shipping them to customers. We currently only ship domestically, and will update this policy if and when we begin to ship internationally.
      2. We do not currently ship any kind of explosive powder at this time, so no gun powder, blackpowder, fireworks, etc will be able to be shipped at this time. We also do not sell spray paint, batteries, acids or other hazardous materials at this time.
      3. Knives and other restricted hand weapons are sold with the understanding that the customer MUST follow and obey all local, state, and federal laws in regards to purchasing, using, carrying, obtaining, and transporting such items since at this time we do not have any way to regulate that for each and every city, state, municipality, town, region, etc. Any account found to be in blatant violation, knowingly or unknowingly, of those regulations and restrictions will be terminated from use on this site without prior notice.
      4. Firearms are subject to federal and state laws and as such will be handled at the top level of regulation required. ALL firearms that leave this store will be serialized and will ship to an FFL in good standing with the ATF, with a currently valid FFL. Failure to provide an FFL will result in delays in your order, and if not corrected will result in the termination of the order, subject to a 20% of the non-sale price of the firearm restocking fee. We do not sell any assembled or “kit” firearms, and we do not have a gunsmith on staff, so those classes of restricted firearms do not apply to this webstore (see ATF regulation updates that pertain to this section here: https://www.atf.gov/rules-and-regulations/definition-frame-or-receiver)
      5. Firearm accessories and parts are not currently regulated federally and enjoy what the 2nd Amendment was written for. In light of that, we will only ship these items to an allowable by law province, town, municipality, city, state, etc. Again, the customer MUST adhere to all applicable laws and regulations, no matter how badly they violate your constitutional rights to own the item. Vote the change! Any customer that is in violation, knowingly or unknowingly, of any applicable regulation will have their account permanently banned from this webstore without prior warning.
      6. We are bound as an FFL holder and legally licensed American business to conduct any and all business fully within the moral and legal bounds of our governing bodies. Any requests to do otherwise will be ignored and your account can be permanently disabled without prior notice, pending the discretion of the business. We do not compromise on ANY legally binding regulations, so just don’t ask.
  12. Conclusion
    1. The above Terms may change at any time, without written notice, and the most updated version of the Terms are the only version that is valid. All previous editions of the Terms, written or otherwise, are considered null and void immediately upon replacement of the Terms on this webstore.
